Ensuring the highest protection for our customers

Clients of Clearing Members have the choice how their positions and margin collateral (cash and securities) are held and posted by their Clearing Member at Eurex Clearing. The level of segregation of collateral and positions will impact how easily porting can be performed. Failure to port in the prescribed timeframe will result in position close out and return of any remaining collateral.

This document sets out the information required to be disclosed under Article 39(7) EMIR. It provides a summary description of each of the clearing models currently offered by Eurex Clearing, including information on the main legal implications of the respective levels of segregation and applicable insolvency law.

 

  • As a CCP authorised under EMIR, we offer both omnibus and individual segregation to Clearing Members and their direct clients. We also offer segregation solutions for indirect clients in line with the regulatory standards.
  • We have offered the most sophisticated range of segregation models since 2011 and continue to be thought leaders in ensuring our models are secure, safe and operationally optimised. Our segregation models have also been tested during recent defaults at the CCP and have been shown to be robust.
  • We work with Clearing Members and clients to ensure each segregation model is as efficient as possible in terms of capital costs, margin eligibility and collateral management, whilst offering clients the flexibility to determine how their positions and collateral are segregated. In an event of default, we continue to provide the broadest range of porting options.
